Términos y Condiciones de Venta

1. Identificación del vendedor

Las obras exhibidas en www.rugerarts.com (en adelante, “el Sitio”) son comercializadas directamente por su autor, Juan Felipe Ruge Rodríguez, artista plástico que firma bajo el nombre RugeR (en adelante, “el Artista”), con domicilio en Bogotá D.C., Colombia, y correo electrónico info@rugerarts.com. Quien adquiere una obra se denominará en adelante “el Comprador”.

2. De las obras

Todas las obras son originales y únicas, ejecutadas a mano por el Artista, salvo indicación expresa en contrario. Las fotografías y los colores pueden presentar ligeras variaciones respecto de la obra real según el dispositivo de visualización. Las medidas se expresan en centímetros (alto × ancho) y pueden presentar pequeñas variaciones.

3. Precios

Los precios se publican en dólares estadounidenses (USD). El valor expresado en pesos colombianos (COP) tiene carácter meramente referencial y se calcula con la tasa de cambio del día. El precio final, la moneda de pago y los costos de envío se confirmarán por escrito antes de perfeccionar la compra. Los precios publicados no incluyen envío, seguro, marco, ni impuestos o aranceles de importación del país de destino.

4. Procedimiento de compra

  1. El interesado deberá manifestar su interés en una obra mediante correo electrónico dirigido a info@rugerarts.com.
  2. El Artista confirmará la disponibilidad, el precio final y el costo de envío al lugar de destino.
  3. La obra quedará reservada a nombre del Comprador una vez recibido el pago total o el anticipo acordado por escrito.
  4. El Artista gestionará el envío y suministrará al Comprador la información de seguimiento.

La publicación de una obra en el Sitio no garantiza su disponibilidad hasta tanto el Artista la confirme, dado que puede ser comercializada a través de otros canales.

5. Medios de pago

El pago se realizará mediante transferencia bancaria. Los datos de la cuenta serán suministrados exclusivamente por correo electrónico desde la dirección info@rugerarts.com. El Artista en ningún caso solicitará datos de tarjetas de crédito ni contraseñas. Cualquier solicitud de pago proveniente de otra dirección deberá ser desatendida y reportada al Artista.

6. Envíos

Se realizan envíos dentro del territorio colombiano y al exterior. Los costos de envío y seguro se cotizarán por separado y estarán a cargo del Comprador. Las obras se embalarán de forma adecuada para su protección durante el transporte. En los envíos internacionales, los impuestos, aranceles y trámites aduaneros del país de destino serán responsabilidad exclusiva del Comprador. Los tiempos de entrega dependerán de la empresa transportadora y del destino, y se informarán al momento de la compra.

7. Certificado de autenticidad

Cada obra se entregará acompañada de un certificado de autenticidad firmado por el Artista, en el que constarán el título, la técnica, las medidas y la fecha de ejecución de la obra.

8. Daños durante el transporte

Si la obra llegare con daños, el Comprador deberá informarlo al Artista dentro de las cuarenta y ocho (48) horas siguientes a la entrega, adjuntando fotografías del embalaje y de la obra, con el fin de adelantar la reclamación ante la empresa transportadora.

9. Derecho de retracto y devoluciones

De conformidad con el artículo 47 de la Ley 1480 de 2011 (Estatuto del Consumidor), en las ventas a distancia el Comprador podrá ejercer el derecho de retracto dentro de los cinco (5) días hábiles siguientes a la entrega de la obra. La obra deberá devolverse en el mismo estado en que fue recibida, con su embalaje y su certificado de autenticidad, y los costos de transporte de la devolución estarán a cargo del Comprador. El reembolso se efectuará dentro de los treinta (30) días calendario siguientes al ejercicio del retracto. Este derecho no aplica a las obras realizadas por encargo, por tratarse de bienes confeccionados conforme a las especificaciones del Comprador.

10. Obras por encargo

El Artista realiza obras por encargo. Las tarifas varían según el tamaño, la técnica, la complejidad y el trabajo creativo de la composición, y se fijarán por escrito junto con el tema, las medidas y el plazo de entrega. Para iniciar la obra se requiere un anticipo equivalente al cincuenta por ciento (50%) del valor final acordado, sin incluir el marco. El saldo se pagará a la entrega de la obra. El anticipo no será reembolsable una vez iniciada la ejecución de la obra.

11. Marcos

El marco no está incluido en el precio de las obras. Si el Comprador lo solicita, el valor total del marco se cobrará en el momento del pago final. Este servicio aplica únicamente para ventas con entrega dentro del territorio colombiano.

12. Propiedad intelectual

Todas las obras e imágenes del Sitio se encuentran protegidas por la Ley 23 de 1982 y la Decisión Andina 351 de 1993. La adquisición de una obra transfiere únicamente la propiedad del soporte material y no los derechos patrimoniales de autor, que permanecen en cabeza del Artista. Se prohíbe la reproducción, copia, impresión, modificación o explotación comercial de las obras o de sus imágenes sin autorización previa y escrita del Artista. El Artista conserva la facultad de fotografiar y exhibir las obras vendidas en su portafolio, redes sociales y exposiciones, indicando que pertenecen a una colección privada.

13. Ley aplicable y peticiones, quejas y reclamos

Los presentes términos se rigen por las leyes de la República de Colombia. Las peticiones, quejas y reclamos podrán dirigirse al correo info@rugerarts.com. El Comprador podrá igualmente acudir a la Superintendencia de Industria y Comercio en su calidad de consumidor.

1. Seller

The works shown on www.rugerarts.com (“the Site”) are sold directly by their author, Juan Felipe Ruge Rodríguez, visual artist signing as RugeR (“the Artist”), domiciled in Bogotá D.C., Colombia, email info@rugerarts.com. Any person acquiring a work is referred to as “the Buyer”.

2. The works

All works are original and unique, executed by hand by the Artist unless expressly stated otherwise. Photographs and colours may differ slightly from the actual work depending on the display device. Dimensions are given in centimetres (height × width) and may vary slightly.

3. Prices

Prices are listed in US dollars (USD). Amounts shown in Colombian pesos (COP) are for reference only and are calculated at the day's exchange rate. The final price, payment currency and shipping costs will be confirmed in writing before the sale is completed. Listed prices exclude shipping, insurance, framing, and any import taxes or duties in the destination country.

4. Purchase procedure

  1. Interested parties must express their interest in a work by email to info@rugerarts.com.
  2. The Artist will confirm availability, the final price and the shipping cost to the destination.
  3. The work will be reserved in the Buyer's name upon receipt of full payment or of the deposit agreed in writing.
  4. The Artist will arrange shipment and provide the Buyer with tracking information.

A work shown on the Site is not guaranteed to be available until confirmed by the Artist, as it may be sold through other channels.

5. Payment

Payment shall be made by bank transfer. Account details will be provided exclusively by email from info@rugerarts.com. The Artist will never request credit card details or passwords. Any payment request from another address must be disregarded and reported to the Artist.

6. Shipping

Works are shipped within Colombia and internationally. Shipping and insurance costs are quoted separately and borne by the Buyer. Works are packed appropriately for protection in transit. For international shipments, import taxes, duties and customs formalities in the destination country are the sole responsibility of the Buyer. Delivery times depend on the carrier and destination and will be stated at the time of purchase.

7. Certificate of authenticity

Each work is delivered with a certificate of authenticity signed by the Artist, stating the title, medium, dimensions and date of execution.

8. Damage in transit

Should a work arrive damaged, the Buyer must notify the Artist within forty-eight (48) hours of delivery, enclosing photographs of the packaging and the work, so that a claim may be filed with the carrier.

9. Right of withdrawal and returns

Pursuant to article 47 of Colombian Law 1480 of 2011 (Consumer Statute), for distance sales the Buyer may exercise the right of withdrawal within five (5) business days of delivery. The work must be returned in the condition in which it was received, with its packaging and certificate of authenticity, and return shipping costs shall be borne by the Buyer. Refunds will be made within thirty (30) calendar days of the exercise of withdrawal. This right does not apply to commissioned works, as these are made to the Buyer's specifications.

10. Commissioned works

The Artist accepts commissions. Rates vary according to size, technique, complexity and the creative work involved in the composition, and will be set in writing together with the subject, dimensions and delivery date. A deposit equal to fifty per cent (50%) of the final agreed price, excluding the frame, is required before work begins. The balance is payable on delivery. The deposit is non-refundable once execution of the work has begun.

11. Frames

Frames are not included in the price of the works. If requested by the Buyer, the full price of the frame will be charged at the time of final payment. This service is available only for sales delivered within Colombia.

12. Intellectual property

All works and images on the Site are protected by Colombian Law 23 of 1982 and Andean Decision 351 of 1993. The purchase of a work transfers ownership of the physical object only and not the economic rights of authorship, which remain with the Artist. Reproduction, copying, printing, alteration or commercial exploitation of the works or their images without the Artist's prior written consent is prohibited. The Artist retains the right to photograph and exhibit sold works in his portfolio, social media and exhibitions, stating that they belong to a private collection.

13. Governing law and complaints

These terms are governed by the laws of the Republic of Colombia. Requests, complaints and claims may be sent to info@rugerarts.com. The Buyer may also contact the Superintendencia de Industria y Comercio as a consumer.
